海洋塑料垃圾污染已成为全球性的环境问题,严重威胁着海洋生物多样性、船舶航行安全以及海洋产业的发展,对海洋塑料垃圾的治理已成为世界各国的一项重要课题。作为全球环境治理的重要一员,中国在海洋塑料垃圾治理方面发挥着重要的作用。从我国在海洋塑料垃圾治理的现状出发,分析发现我国在海洋塑料垃圾治理方面存在法律体系不健全、制度不完备等约束性缺陷,提出运用科技创新手段、加强多元治理、构建公众参与的治理体系和路径,以及完善法律体系、创新法律实践、强化监管执法机制等法律措施。

Marine plastic waste pollution has evolved into a global environmental issue that severely threatens marine biodiversity, the safety of ship navigation and the development of marine industries. Addressing this pollution has become a critical task for countries worldwide. As an important participant in global environmental governance, China plays a pivotal role in tackling marine plastic waste. Starting from the current status of China's marine plastic waste management, this paper analyzes and finds that the institutional deficiencies such as an incomplete legal system and inadequate mechanisms in China's governance efforts. It proposes governance systems and pathways including leveraging scientific and technological innovation, strengthening diversified governance, and constructing of public participation governance framework-based. Additionally, legal measures such as improving the legal system, innovating legal practices, and enhancing supervision and law enforcement mechanisms are put forward.
